                <h3>1. Restriction of Access</h3>
                In this segment "Officially Restricted" means/includes ESTsoft Inc., ESTsoft Corp., NBird LLC, SDO, SNDO and SNDA.

                <br>No one from Officially Restricted, associated with Officially Restricted or any such affiliated company or anyone directed by Officially Restricted or its related companies is permitted to enter these web sites or view any content contained within these sites at any time what so ever due to controversial reasons.

                Each time you use or cause access to this web site or services, you agree to be bound by these Terms of Service, and as amended from time to time with or without notice to you. In addition, if you are using a particular service on or through this web site, you will be subject to any rules or guidelines applicable to those services and they shall be incorporated by reference into these Terms of Service.

                Our web sites and services provided to you on and through our web site on an AS IS basis. You agree that the owners of this web site exclusively reserve the right and may, at any time and without notice and any liability to you, modify or discontinue this web site and its services or delete the data you provide, whether temporarily or permanently. We shall have no responsibility or liability for the timeliness, deletion, failure to store, inaccuracy, or improper delivery of any data or information.

                <br>PlayGalaxy reserves the right to interrupt the Service from time to time on a regularly scheduled basis or otherwise with or without prior notice in order to perform maintenance.

PlayGalaxy shall not be liable for any interruption of the Service, delay or failure to perform resulting from any causes beyond its reasonable control.

                <h3>4. Your Responsibilities and Registration Obligations</h3>
                In order to use our web sites and services, you must register first, and agree to provide truthful information when requested.
                <h3>5. Account</h3>
                During the registration process, you will be required to select a user name and a password that are specific to the Account (collectively known as the "Password"). Your Password is to be kept confidential at all times and you are solely responsible for the security of your Password. You may not disclose your Password to anyone, or allow your Password to be used by anyone other than yourself and/or your one minor child. PlayGalaxy is not responsible for any harm that may result to the Account (including without limitation the deletion or modification of characters in the Account) as a result of a lost or shared password. The user name you choose shall be subject to the naming guidelines contained in this Agreement. PlayGalaxy is not responsible in the event that the Account is "hacked," or if the Account or your computer is damaged by a virus, or for any other issues with your computer or the Account. If you think that the Account has been compromised, please contact PlayGalaxy Technical Support, either through our GM or Help Desk support system.

                <br>Donations:
                <ul class="text-left">
                    <li>Donations are NOT required to use our Service, but note that users who Donate receive gifts based on the proportion of their contribution. You agree that users who contribute deserve to receive gifts, because Donations help keep the Community alive and you agree to be part of the Community by using our Web Sites and/or Service. You hereby agree to Donate, though PlayGalaxy, in its sole and absolute discretion, can suspend or terminate your access to the Service and disable or delete the Account if you violate any terms form our Agreement. Also PlayGalaxy is not responsible for Donation issues caused by either SMS Company, Paypal Company, Bank Company or Phone Network Company.</li>
                </ul>
                <br>Account Transfers:
                <ul class="text-left">
                    <li>PlayGalaxy does not recognize the transfer of Accounts, and doing so will result in the permanent banning of the Account. You may not offer any Account for sale or trade, and any such offer is a violation of this Agreement and may result in suspension or termination of the Account. There are no refunds where the Account is terminated/banned.</li>
                </ul>
                <br>Account Email:

                    <li>Changing your account email is not allowed. Make sure you register with an email that you have access to.</li>
                </ul>
                <h3>6. Cash Vouchers</h3>
                Vouchers provide a straightforward method for players to exchange cash purchased through our website with other players in the game. This system enables players who may not have the means to spend real money to acquire cash from others, which they can then use in the in-game item shop.

                <h3>7. Refund Policy</h3>
                Real Money Purchases:
                <ul class="text-left">
                    <li>PlayGalaxy offers refunds for purchases within the first 14 days from the date of purchase. Refunds will not be available if 14 days have elapsed since your purchase. To qualify for a refund, Cabal Coins must not be in circulation and must still be present in your account, allowing us to deduct the amount to be refunded. Once the refund amount has been deducted, the refund will be processed using your original method of payment (e.g., PayPal, Cryptocurrency, etc.).</li>
                    <li>Please note if you generate vouchers and use them in-game, we cannot refund the amount spent to generate them. If you have not received a refund yet, please recheck your bank account. Additionally, you may want to contact your credit card company as it may take some time before your refund is officially posted. If you have taken these steps and still have not received your refund, please contact us by creating a ticket on our Discord server or by sending an email to support@PlayGalaxy.to.</li>
                </ul>
                <br>In-Game Mistakes:
                <ul class="text-left">
                    <li>Actions made by mistake (e.g., wrong item purchase, incorrect registration, listing at the wrong price, failure to upgrade due to missing safeguards) will not be refunded.</li>
                </ul>
                <h3>8. Your Conduct (General)</h3>
                You agree that all information or data of any kind, whether text, software, code, music or sound, photographs or graphics, video or other materials (Content), publicly or privately provided, shall be the sole responsibility of the person providing the Content or the person whose user account is used. You agree that our web site may expose you to Content that may be objectionable or offensive. We shall not be responsible to you in any way for the Content that appears on this web site nor for any error or omission.

                <br>You explicitly agree, in using this web site or any service provided, that you shall not:

                    <li>Collect or harvest any data about other users; </li>
                    <li>Provide or use this web site and any Content or service in any commercial manner or in any manner that would involve junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorized advertising without our prior written consent.</li>
                </ul>
                <br>Naming Restrictions, in particular, you may not use any name:
                <ul class="text-left">
                    <li>Belonging to another person with the intent to impersonate that person, including, without limitation, an agent of PlayGalaxy; </li>
                    <li>Belonging to any religious figure or deity; </li>
                    <li>Subject to the rights of any other person or entity without written authorization from that person or entity; </li>
                    <li>That belongs to a popular culture figure, celebrity, or media personality; </li>
                    <li>That is, contains, or is substantially similar to a trademark or game mark, whether registered or not; </li>
                    <li>Related to drugs, sex, alcohol, or criminal activity; </li>
                    <li>That incorporates 'swear' words or which are otherwise offensive, defamatory, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable; </li>
                    <li>Comprised of partial or complete sentence; </li>
                    <li>Comprised of gibberish. </li>
                </ul>
                <br>You may not use a misspelling or an alternative spelling to circumvent the name restrictions listed above, nor can you have a "first" and "last" name that, when combined, violate the above name restrictions.

                <br>PlayGalaxy may, in its sole and absolute discretion, take whatever action it deems necessary to preserve the integrity of Services. Violation of any of the terms and conditions set forth above may result in actions being taken by PlayGalaxy, effective immediately or at a time determined by PlayGalaxy, which may include without limitation: temporarily suspending your access to our Service, or permanently terminating your access to our Service. Without limiting the foregoing, PlayGalaxy retains the right to decline Services to any user who violates the Agreement.
                <h3>9. Social Guidelines & Chat Rules</h3>
                <ul class="text-left">
                    <li>No Racism: Racism is not allowed in chat, character names, guild names, or notes. Definition: Racism includes systems, policies, actions, and attitudes that create inequitable opportunities or outcomes based on race.</li>
                    <li>No Harassment: Harassment is not tolerated and includes behavior intended to harm another player's psychological well-being.</li>
                    <li>Examples of harassment include: Family insults, Real-life threats/intimidation, and Racist behavior.</li>
                    <li>Exceptions: Trash talk is allowed and is not considered harassment. Being "hunted" in-game due to an argument is also not considered harassment.</li>
                    <li>English in Megaphone Chat: Please use English in megaphone chat, unless you're recruiting for your country guild or sharing relevant information with your language community. Note: Any spam or arguments in other languages may result in warnings or temporary bans, depending on the situation.</li>
                </ul>
                <h3>10. Game Mechanics & Fair Play</h3>
                PlayGalaxy may, in its sole and absolute discretion, take whatever action it deems necessary to preserve the integrity of Services. Violation of any of the terms below may result in temporary suspension or permanent termination of access.
                <br>
                <br>No Cheating/Bug Exploiting:
                <ul class="text-left">
                    <li>Cheating will result in a permanent or hardware ban.</li>
                    <li>Repeated bug exploitation in PvE will lead to a warning, 14-day ban, or permanent ban.</li>
                    <li>In PvP, the consequence is a 14-day ban or permanent ban.</li>
                    <li>No Macros for Active Grinding: Using macros for active grinding or similar activities is forbidden.</li>
                    <li>First offense: 7 - 14 day ban.</li>
                    <li>Second offense: 14 - 30 days or permanent ban depending on the situation.</li>
                    <li>No Exploit Abuse: Any kind of exploit abuse is bannable. Please report any discovered exploits to Administrators/Developers directly.</li>
                    <li>No AFK DP Farming or Multi-Account DP Farming: AFK farming (leaving your character running tasks without actively playing) and multi-account farming (using multiple accounts to farm or gain rewards) are prohibited. These practices can unfairly manipulate the game and disrupt the balance.</li>
                    <li>AFK Dungeon Farming: It is not allowed to enter a dungeon and stay AFK to solely receive Dungeon Points (DP). This includes running a dungeon with multiple accounts where only one character is actively participating, or having a strong friend run the dungeon while you stay AFK. All characters in the dungeon must be actively engaged in the activity.</li>
                    <li>AFK in TG: Using AFK macros in TG is strictly prohibited. This includes, but is not limited to, actions such as spamming Heal as a Force Archer (FA) on yourself while remaining AFK, or any other form of automated or unattended actions.</li>
                    <li>First offense: 14-day ban.</li>
                    <li>Second offense: Permanent ban.</li>
                    <li>No Scamming: Any form of fraud is prohibited.</li>
                </ul>
                No Merging/Gifting/Piloting:
                <ul class="text-left">
                    <li>Merging: Merging accounts (combining or transferring items/wealth across accounts to unfairly boost a player's power or wealth) is strictly prohibited. If you merged before this rule was introduced, you may continue to play that account, but you are not allowed to use second or third accounts to transfer Alz or items to the merged account. If we catch you transferring items or Alz to the main account, the first offense will result in a 30-day ban as a warning. If the behavior occurs again, all accounts connected to the main account will be permanently banned.</li>
                    <li>Funneling: Transferring in-game currency or items between multiple accounts to boost a main character, even if all accounts belong to the same player, is not allowed. All accounts must be played and maintained independently.</li>
                    <li>Gifting: Gifting high-value items or large amounts of in-game currency (Alz) is not permitted, except when assisting a new player in a genuine and reasonable way. Receiving large quantities of items or Alz from a player who is quitting the game or from another account you own is strictly forbidden.</li>
                    <li>Piloting: You are not allowed to have someone else play on your account to gain an advantage over other players.</li>
                </ul>
                <h3>11. Real Money Trading (RMT)</h3>
                Zero Tolerance Policy:
                <ul class="text-left">
                    <li>We maintain a zero-tolerance policy for Real Money Trading (RMT) as it undermines the integrity of the server and directly affects the game’s economy. Any account involved in RMT will be permanently banned without exception. We take this issue very seriously and conduct thorough investigations to ensure absolute certainty before making any decisions. There are no warnings when it comes to RMT violations.</li>
                    <li>Buying or selling in-game items, currency, or accounts for real money is strictly prohibited.</li>
                    <li>Account selling, whether through real money or in-game currency, is also forbidden.</li>
                    <li>Offering real money (e.g., euros) for items or Alz in exchange, even if the transaction is not completed, will result in a temporary ban.</li>
                    <li>Attempting to sell items or requesting real money (instead of in-game currency) for items is also prohibited.</li>
                    <li>Any suspicious activity related to RMT will result in an investigation, and any involved accounts may be suspended.</li>
                    <li>Players are encouraged to report and provide evidence if they suspect fraudulent RMT activities. We have the ability to track all such activities; anyone who thinks they’ve “gotten away” with it simply hasn’t been caught yet.</li>
                </ul>
                <h3>12. Support & Ticket Privacy</h3>
                Respect ticket privacy. Sharing ticket information in public spaces (in-game or Discord) will result in punishment.

                <h3>13. Submission of Content on this Web Site</h3>
                By providing any Content to our web site:
                <ul class="text-left">
                    <li>You agree to grant to us a worldwide, royalty-free, perpetual, non-exclusive right and license (including any moral rights or other necessary rights) to use, display, reproduce, modify, adapt, publish, distribute, perform, promote, archive, translate, and to create derivative works and compilations, in whole or in part. Such license will apply with respect to any form, media, technology known or later developed; </li>
                    <li>You warrant and represent that you have all legal, moral, and other rights that may be necessary to grant us with the license set forth in this segment; </li>
